Welcome to ZipTunnel.com (“ZipTunnel,” “we,” “our,” or “us”). By signing up for or using our services (“Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, do not use the Service.

1. Eligibility and Acceptance

1.1. By creating an account or using the Service, you confirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and legally capable of entering into this agreement.
1.2. Use of the Service constitutes acceptance of these Terms.

2. Service Description

2.1. ZipTunnel provides a Zero Trust Internet Access and related security service intended to help protect user privacy, block certain malicious domains, and reduce online risks.
2.2. We do not claim or guarantee 100% protection against cybersecurity threats, including but not limited to hacking, malware, phishing, ransomware, or other malicious activities.

3. No Guarantee of Results

3.1. You acknowledge and agree that:

  • No security service can provide complete protection.
  • Use of the Service does not ensure immunity from cyberattacks, data breaches, malware infections, financial loss, or other harms.
  • We make no warranty, express or implied, regarding the accuracy, completeness, or reliability of the Service.

4. No Indemnity

4.1. No Indemnity Clause: Neither you nor ZipTunnel are obligated to indemnify or compensate the other for any losses, damages, liabilities, or expenses arising from or related to the use of the Service.
4.2. Each party bears its own responsibility for any harm or loss experienced.

5. Limitation of Liability

5.1. To the maximum extent permitted by law, ZipTunnel shall not be liable for:

  • Direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to financial loss, data loss, loss of business, or reputational harm.
  • Claims related to third-party acts, cyber incidents, or unauthorized access to your data.
    5.2. In jurisdictions where limitation of liability is restricted, our liability shall not exceed the amount you paid for the Service in the past 12 months.

6. No Legal Actions / No Lawsuits

6.1. By using the Service, you waive the right to bring lawsuits, class actions, or other legal claims against ZipTunnel arising from use of the Service.
6.2. If any dispute arises, it shall be resolved through binding arbitration (U.S.) or competent civil courts in the EU member state of your residence, subject to mandatory consumer protection laws.

10.1. U.S. Users: These Terms shall be governed by the laws of the State of Delaware, United States, excluding its conflict of law provisions.
10.2. EU Users: These Terms shall be governed by the laws of your country of residence, and mandatory EU consumer protection law shall apply.

11. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
